This tool is intended for general information and guidance. It allows a director to understand, in a few minutes, what the Provincial Courts of Appeal require today before an unpaid debt is reported to a credit default register, and where the company's internal process may be falling short.
It is a starting point for a conversation. It is not the end of an analysis.

Check the references against the official texts
The references to legislation and case law you will see must be checked against the official texts before you take any decision.
Judgments are cited in abbreviated form and for the criterion they set, not in their full wording. A decision may have been appealed, qualified or superseded by a later one, and the case law of the Provincial Courts of Appeal is not uniform across the country. Always check against the Boletín Oficial del Estado (the Spanish official gazette) and the search facility of the Consejo General del Poder Judicial (the Spanish General Council of the Judiciary).
How your result is calculated
The results are calculated from the answers you provide, without any review of your actual documentation, so they are necessarily indicative.
The engine checks nothing: it takes every answer at face value. If you answer that your clause identifies the register, the calculation assumes it does. An optimistic answer produces an optimistic result, and an imprecise answer produces an imprecise result.
That is why “I don't know” counts as risk: in these claims the burden of proof falls on your company, and what cannot be proved behaves, before a judge, as if it did not exist.
The figures are indicative ranges
The final figure in a case depends on circumstances this tool does not know: how widely the data was circulated, how long it stayed in the register, the harm proved, how your company behaved once it was put on notice, and the approach of the particular Court of Appeal. Costs are not included in the range.
The annual estimate we show you multiplies a percentage of entries at risk by the number of entries you declare and by that average award. It is deliberately simple arithmetic, designed to size the problem, not to quantify an accounting contingency or to set a provision.
Do not use it as the basis for an investment decision, a negotiation, a due diligence exercise or a report to your board without a professional reviewing it first.
This statement authorises nothing about your data
This statement is separate from any consent regarding your data: accepting it does not authorise any processing. Your data protection decisions are asked for separately, purpose by purpose, and you can change them whenever you like from the footer.
